Magnimark Pty Ltd owns the intellectual property of the www.mogochildrensfurniture.co.za website (the “site”), and the right to display all the elements of it. Magnimark operates the site. Throughout the site, the terms “us, “we”, “our” refer to Magnimark, and the terms “you”, “your” refers to the User and/or Customer.

We may, at our sole discretion, change this agreement or any part thereof at any time without notice.

General terms and conditions constitute the agreement, and regulate the relationship, between us and you, for use of the site, and for any purchase from the site. You are requested to carefully read the general terms and conditions before using the site or placing an order.

These terms and conditions shall be governed by, and construed, in accordance with South African law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the South African courts.

LIT Creations, together with WordPress Hosting, host the site. They provide us with the online e-commerce platform that allows us to sell our products to you.

We reserve the right to refuse business to anyone for any reason at any time.

All the information on this site is published in good faith and for general information purpose only. We do not make any warranties, about the completeness, reliability and accuracy of this information, or that the site will meet all your requirements 

We reserve, unconditionally, the sole and absolute right to alter or change, price, information and any form or nature of promotions without any notice. We will not be liable to you (whether under the law of contract, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, this site.

By using this site, you agree that the exclusions and limitations of liability as set out in the site disclaimer are reasonable, and you hereby consent to our disclaimer and agree to its terms. If you do not think they are reasonable, you must not use this site.

Privacy Policy
We shall take all reasonable steps to protect your personal information. For the purpose of this clause,” personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The site processes your personal data in compliance with the provisions of the PAIA. Your personal data is processed within the scope necessary to accept and fulfil your order. As such we may need to share your personal data with third parties (examples are delivery companies and online payment intermediaries).

You are hereby cautioned that any online communications may not be confidential. In the course of performing duties and work, we may also disclose any communications to the extent permitted or acquired by prevailing legislation from time to time.

We collect minimum personal information in order to handle orders, deliver products and process payments and refunds. Your contact details are kept only in the site database. We may also provide online and e-mail communications to you, with the aim to send personal offers, promotions, and news, and shall do so acting reasonably and in good faith. Product and prices
We offer our own uniquely designed furniture and accessories. We reserve the right to show all the products resembling each as closely as possible, but cannot guarantee that products seen on screen are the same as in reality. Accordingly, products shipped to you may differ slightly from those depicted on this site or in promotional materials.

Please note that we reserve the right to alter or modify minor details of the products featured on this site if required to maintain and improve product quality and design integrity.

You are responsible for the correct assembly of the supplied products by following instructions shipped within the packaging.

All the products available on the site are subject to the availability at the time of the order. The offering on this site is available in South Africa only. All prices on the site are in South African Rands (ZAR). The prices of the products do not include shipping costs, which will be calculated and shown at check-out, and will be included in the confirmation of the order. All product prices include 15% VAT.

Prices for our products are subject to change without notice, and as such the prices can vary at any time. We do our best to ensure that all pricing information on the site is accurate, but cannot guarantee that errors won’t occur. In the event that an error in the price of a product occurs, you will be given the option to confirm the purchase of the product at the correct price or to cancel the order.

Order and Payment

The product details and the price are included in the product’s description on the site. You shall choose the product(s) by pushing the “add to cart” button. Once product(s) have been selected then go to “check-out” where total costs, including shipping, is displayed. Acceptance of the Terms and Conditions is required before proceeding to the payment options. You selects from the available payment options, and payment can be completed.

The order submitted by you shall only be deemed complete when the purchase procedure has been correctly completed and payment made.. You will receive an e-mail confirming the receipt of the order placed. It is your responsibility to verify the content of the e-mail and notify us of any errors.
The price is payable upon placement of the order, and you undertake to pay the total price of the product(s) and shipping costs as stipulated on the site. The order will not be processed at the factory until the payment has cleared.

Payfast is the payment gateway for all payment transactions on the site. Payment can be made via Visa and Master Card credit cards, or by bank transfer (direct eft) into our Payfast account. Funds take 48 hours to clear. Payfast will advise us and you of any issues relating to the payment. Neither us, nor Payfast, has access to your bank or card details. Shipping and delivery
Products are delivered to the address indicated by you when completing the order form. Careful attention should be given to ensuring correct delivery details to avoid problems on delivery. Please be sure to provide the correct email, delivery address and delivery contact number on your order. Deliveries can only be made to a physical address.

Once your order has shipped, you will receive an email notification with tracking information.
Delivery times are indicated on the website. If delivery of the product(s) ordered is expected to take longer than indicated, we undertake to inform you as soon as possible and to indicate when the product will be delivered. You then have the option to wait for the delivery of the product or obtain a refund.

Once the product(s) have been handed over to the Courier (carrier) delivery will be deemed to have taken place. Please note that all items are shipped directly from our factory and we cannot be held responsible for any neglect or fault on the part of the courier. We undertake to try our best to resolve any possible problems that may arise. In event of undelivered products due to fault of Courier (carrier) you will be given the option to wait for the order to be replaced or for a refund. In the event of undelivered products due to your absence, wrong address, or refusal on delivery, the product(s) will be returned to us, and we reserve the right to refund to you the price of the product(s). The delivery and return costs remaining payable by you.

We take care to package items carefully and properly. However, transit-related damage can occur. When an order arrives, please inspect it carefully, and if you notice any damage please notify us immediately (within 24 hours) at info@mogochildrensfurniture.co.za. Refer to our Warranty and Returns policy below.

Warranty and returns
We take responsibility for aspects relating to the sale of goods, manufacturing and delivery. We offer high quality products, with due care taken in making of each item. All items are inspected at the factory prior to shipping to you. We take responsibility for all manufacturing faults and have a six(6)-month manufacturing warranty, calculated from the date of delivery of product(s). We do not take responsibility for injury, or damage to items caused by misuse, or if instructions for assembly and use were not adhered to.
(please note that the items are not toys, and as such are not made for playing or jumping on)

In the unlikely event that you have a problem with a product, please contact us. If a product fault is covered under the terms of the warranty, we shall repair the products, supply a replacement or replacement part, or refund the purchase price at our discretion. Any shortages, damages or defect must be reported within twenty four (24) hours of receipt of delivery, at info@mogochildrensfurniture.co.za. Thereafter, we no longer take responsibility. On delivery receipt ensure you personally inspect the packaging and make a note any visible damage on the receipt note before signing for it. Furthermore, if you have not opened the package write a comment stating the contents have not been inspected.
Please explain the problem or defect and include the following photographs, so that we may best assist you
1. A picture of the complete outside of the box, clearly showing the parcel label
2. A picture of the opened box, clearly showing the content and the interior packing
3. A picture of the complete size of the article
4. A detailed picture (close-up) of the concrete damage of the article.
Claims will require original packaging. We will do our best to resolve whatever issue there is as quickly as possible.

Any approved claims will be shipped free of charge. Replacements can only be manufactured once it was determined that there was a manufacturer defect, or damage during delivery. Items damaged during delivery will be replaced with the same or similar item at no charge. If it is subsequently found that the returned merchandise is not defective or damaged, the customer will be liable for all shipping costs.

We will consider reasonable requests to return goods. All returns are subject to pre-approval, ie you must contact us beforehand at info@mogochildrensfurniture.co.za , and will be based on a case by case basis. The items must be in their original condition, unused and returned in their original packaging with original literature. Items must be returned within seven (7) days of receipt and will be subject to a return transport fee.
Returns, and claims, where the product packaging that has been defaced will not be accepted.

In event of a refund (for Claim or Return) we will refund you the purchase price of the product(s) within thirty (30) days from date the product(s) is received by us. The delivery costs are not refundable. We will not be held responsible for the refund or the compensation of products that have been lost, stolen or damaged.
We do not take responsibility for the disposal of packaging

Cancellation Policy
Cancellation of orders by you after production has commenced will attract a fee of 50% of the product(s) cost.
